What is sc st act amendment 2015: The Scheduled Castes and Scheduled Tribes Act, 1989 was passed by the Indian Parliament on September 11, 1989, which was implemented from 30th January 1990 onwards throughout India. The Scheduled Castes and Scheduled Tribes Act act applies to every person who is not a member of Scheduled Castes and Scheduled Tribes and that person harasses members of this class. There are 5 chapters and 23 streams in this Act.

What does this law do?

There are three characteristics of this law:

  • This act punishes offenses against individuals belonging to Scheduled Castes and Scheduled Tribes.
  • It gives special protection and rights to the victims.
  • It establishes courts, which can handle cases quickly.

What types of crimes have been penalized under this law?

For some such crimes which are included in the Indian Penal Code, more punishment has been set in this law. The cruel and abusive crimes against the members of Scheduled Castes and Scheduled Tribes, such as forcing them to forcibly feed non-food (stools, urine etc.) or their social exclusion, is considered to be an offense under this law. 20 More acts are included in the crime category.

What is an economic boycott?

If a person refuses to do business with a member of a Scheduled Caste / Scheduled Tribe then it will be called an economic boycott.
The following activities will fall into the category of economic exclusion:
Refusal to work or hire a member of a Scheduled Caste / Scheduled Tribe.
Not providing services to the Scheduled Castes / Scheduled Tribe members or providing the services.

What is social exclusion?

Social exclusion occurs when a person refuses to contact a person or tries to keep them separate from other groups.

Duties of Government Officials:

1.Filing FIR / Complaint
2.Before taking the sign, read and recite the statement given in the police station.
3.Give copies of the statement to the person giving information.
4.Record affidavit or witness statement
5.Investigation of crime within 60 days of filing FIR and presenting charge sheet
6.Document preparation and accurate translation of documents.

Things which you can not do with SC/ST:

This act applies to a person who is not a member of Scheduled Castes and Scheduled Tribes and commits crimes against members of this class. According to Section 3 (1) of the Act, whoever is not a member of the Scheduled Caste, Scheduled Tribes and commits the crime of the following atrocities on members of this class, then the law will be treated as a penal offense.

These things are :

1. For the feeding of inedible or disgusting (stool urine etc.) to the Scheduled Castes / Scheduled Tribe members forcibly.
2. Throwing dead body of the animal with the intention of physically injuring a member of Scheduled Caste, Scheduled Tribes around him or his family.
3. Forcing people of the Scheduled Castes and Scheduled Tribes to undress or to disguise themselves or to paint them on their face, move in public or perform such a task that is against human dignity.
4. Taking off farming from the land of a Scheduled Caste, Scheduled Tribe, illegally by cultivating land or taking possession of the land.
5. Interference in the consumption of a member belonging to Scheduled Caste, Scheduled Tribes.
6. Forcing members of Scheduled Castes, Scheduled Tribe to beg for their begging or to compel them to be as a Bandhu worker or to seduce them.
7. To not allow voting for a Scheduled Caste, Scheduled Tribe, or forcing a particular candidate to vote.
8. False against a member of Scheduled Caste, Scheduled Tribes, entrapment or taking action by making it a full criminal or other legal charges with the intention of harassing or taking action.
9. To provide any false or trivial information or information to a public servant (government employee/officer) and to make such public servant a liar for his loss or distress to a member of Scheduled Caste, Scheduled Tribes, using his method of full power.
10. Deliberately humiliating any member of Scheduled Caste, Scheduled Tribe, in public eyes by humiliation, scare.

14. Preventing Scheduled Caste, Scheduled Tribe members from going to any public place, depriving them of conservative rights or preventing them from knowing where they can go. 15. Forcing a Scheduled Caste, Scheduled Tribe to leave his house or place of residence or compel him to do so.

Punishment:

For the crimes of atrocities described above, the guilty person has provisions for six months to five years, with fine, fine. For the crime of cruel murder, there is a sentence of death penalty.
